Warranties

General Warranty – “Subcontractor” provides a one year limited general warranty against defective materials and craftsmanship as specified in this contract – ‘Section 19.00: Contract Warranties’. All warranty issues must be reported to “SELLER” in writing within ten (10) business days of discovery. If warranty issues are reported after ten (10) business days, the “SELLER” is not deemed liable or responsible for subsequent or consequential damage(s) caused by the originating issue. Warranty service provided under this section covers material and labor repairs to the reported defective issue only, and warrants restoring the defect to working order. The “SELLER” reserves the right to charge a one-time trip fee for each reported issue.

Pool Shell Warranty – “Subcontractor” provides a limited “non-transferable” Lifetime warranty against defects, cracking, and leakage. This warranty does not cover damage to the pool shell caused by: a.) Acts of God; b.) plant roots; c.) owner neglect; d.) improper chemistry; e.) ground shifting, and/or f.) underground PVC plumbing leaks around pool or spa returns, main drains, and skimmers unless specified otherwise in this contract, Section 17.00: Contract Warranties. “SELLER” does not provide a warranty preventing the pool shell from shifting or popping out of the ground after the shell has been plastered.

Plaster Warranty – “Subcontractor” provides a limited ten (10) year warranty for Pebble-Tec, Pebble Sheen & Pebble Fina finishes, or as otherwise warranted by the plaster product manufacturer. “SELLER” does not offer or provide warranty coverage against plaster cracks, discoloration, or non-aggregate color plastered finishes. This warranty does not cover damage to the plaster caused by: a.) Acts of God; b.) owner neglect; c.) ground or pool/spa shifting; and/or d.) “lack of maintenance and improper water chemistry”.

Pool Equipment Warranty – “EQUIPMENT MANUFACTURER” provides a limited three (3) year pool equipment warranty on materials and workmanship. This warranty does not cover damage to the equipment caused by: a.) Acts of God; b.) plant roots; c.) owner neglect; d.) improper chemistry; e.) ground shifting, and/or f.) work performed on the pool equipment by anyone other than “SELLER” unless specified otherwise in this contract – Section 19.00: Contract Warranties. Please see equipment manufacturer warranty information.

Pool Equipment – Polaris Cleaner Warranty – “EQUIPMENT MANUFACTURER” provides a limited one (1) year cleaner equipment warranty on materials and workmanship. This warranty does not cover damage to the equipment caused by: a.) Acts of God; b.) plant roots; c.) owner neglect; d.) improper chemistry; e.) ground shifting, and/or f.) work performed on the cleaner equipment by anyone other than “SELLER” unless specified otherwise in this contract – Section 19.00: Contract Warranties.

Plumbing Warranty – “Subcontractor” provides a limited one (1) year pool plumbing warranty on materials and workmanship. This warranty does not cover damage to the plumbing caused by: a.) Acts of God; b.) plant roots; c.) owner neglect; d.) improper chemistry; e.) ground shifting, and/or f.) underground PVC plumbing leaks around pool or spa returns, main drains, and skimmers unless specified otherwise in this contract – Section 19.00: Contract Warranties.

 

Electrical Warranty – “Subcontractor” provides a limited one (1) year pool electrical warranty on materials and workmanship. “SELLER” only warrants work done between the homes service panel and the pool equipment pad. This warranty does not cover damage to the electrical wiring or conduit caused by: a.) Acts of God; b.) plant roots; c.) owner neglect; d.) improper chemistry; e.) ground shifting, and/or f.) underground digging around pool or spa facility area unless specified otherwise in this contract – Section 19.00: Contract Warranties.

New Construction Tile and Coping Warranty – “Subcontractor” provides a limited one (1) year warranty,. “SELLER” does not offer or provide a warranty against cracking of grout and/or thinset materials used to secure stone or tile. This warranty does not cover damage to the tile and coping caused by: a.) Acts of God; b.) plant roots; c.) owner neglect; d.) improper chemistry; and/or e.) ground shifting unless specified otherwise in this contract – Section 19.00: Contract Warranties.

Renovation Tile and Coping Warranty – “Subcontractor” provides a limited one (1) year tile and coping warranty on materials and workmanship. “Subcontractor” does not offer or provide a warranty against cracking of grout, and/or thinset materials used to secure stone or tile. This warranty does not cover damage to the tile and coping caused by: a.) Acts of God; b.) plant roots; c.) owner neglect; d.) improper chemistry; and/or e.) ground shifting unless specified otherwise in this contract – Section 19.00: Contract Warranties.

Concrete Walkway and Deck Warranty – “Subcontractor” provides a limited one (1) year walkway and deck warranty on materials and workmanship. “Subcontractor” does not offer or provide a warranty against cracking, chipping, raising, settling or discoloration. This warranty does not cover damage to the walkway and deck caused by: a.) Acts of God; b.) plant roots; c.) owner neglect; d.) flooding; and/or e.) ground shifting unless specified otherwise in this contract – Section 19.00: Contract Warranties.

Wood Structure Warranty – “Subcontractor” provides a limited one (1) year wood structure warranty on materials and workmanship. Wood structures include decking, patio covers, pergolas, gazebos and fencing. “Subcontractor” does not offer or provide a warranty against discoloration, wood splintering and wood splitting. This warranty does not cover damage to wood structures, decks, patio’s, pergolas, gazebos, and fences caused by: a.) Acts of God; b.) plant roots; c.) owner neglect; d.) flooding; and/or e.) ground shifting unless specified otherwise in this contract – Section 19.00: Contract Warranties.

Implied Warranty – Neither “SELLER” nor “Subcontractor” offer any warranties, implied, verbal, oral, expressed, promised, or otherwise deemed implied, verbal, oral, expressed, or promised. No warranty(ies) is(are) offered without written authorization between “BUYER” and “SELLER” and/or that is not inclusive within ‘Section 19.00: Contract Warranties” as accepted and agreed upon by contract signature or page initials herein. Warranties cannot be offered by the “SELLER(S)” representative(s), contractor(s), sub-contractor(s), or employee(s) outside of this contract. All warranties will be in writing and signed by both “SELLER” and “BUYER”.

Effective Warranty – Warranties defined in this contract are effective only if and when the “BUYER(S)” comply (ies) with this contract in its entirety to include all payment schedules defined herein. All warranties, or portions thereof, become void if: a.) the “BUYER(S)” do(es) not keep the pool and/or spa vessel full of “healthy” (as defined in Section 18.01 A. through E.) pool water at all times; b.)  Acts of God; c.) plant roots; d.) owner neglect; e.) flooding; f.) ground shifting; and/or g.) change of home ownership.

Renovation Warranty – All warranties detailed in this section apply to renovations, remodels, and restoration only if “SELLER” and “Subcontractor” completes the work described in this contract. The “BUYER(S) and/or company(ies) that “BUYER(S)” hire(s) to perform any portion of the work defined in this contract will void any warranty promised by any “Subcontractor” for the work performed. “Subcontractor” does not and will not warrant any work that is not performed by “Subcontractor”. Furthermore, the “Subcontractor” and “SELLER” are not held accountable (liable) for any work performed in or around the pool structure by others for any and all reasons during pool modification or after contract completion.
